Class-action lawsuit against X.ai’s Grok tool expands with new plaintiffs alleging CSAM creation

Based on information from CyberScoop, a class-action lawsuit against X.ai's Grok tool has been expanded to include new plaintiffs, including minors, who allege the AI was used to create nonconsensual child sexual assault material (CSAM) based on their personal images.

The lawsuit, initially filed by three women, now includes two additional anonymous plaintiffs, Jane Does 4 and 5. Jane Doe 4, a minor, claims her stepfather used Grok to generate over 7,000 CSAM images from a photo of her at age 11, which were then shared online. The suit alleges Grok was chosen for its less restrictive nature.

The lawsuit also names Stability AI as a defendant, claiming its Stable Diffusion 1.0 model, trained on a dataset containing explicit material, was released without adequate safeguards, allowing for the creation of CSAM. Despite initial classifiers, downstream developers could bypass protections. The complaint states Stability AI later rolled back stronger guardrails in response to user complaints, fostering an ecosystem of modified apps. The plaintiffs report severe emotional distress, humiliation, and ongoing anxiety due to the dissemination of the illicit material.
