Admin of BreachForums gets three years in resentencing

The U.S. has resentenced Conor Brian Fitzpatrick, also known Pompompurin, to three years' imprisonment over his role as the creator and operator of the infamous cybercrime marketplace BreachForums, CyberScoop reports.

In July 2023, Fitzpatrick pleaded guilty to conspiracy to commit access device fraud, possession of child sexual abuse material, and solicitation concerning fraudulent access devices. He initially received 17 days in custody, time served, along with 20 years of supervised release.

Records show that while legal proceedings were underway, he violated court conditions by using a virtual private network to access Discord chat rooms, where he questioned his guilty plea. He regretted not contesting the charges and made comments that downplayed the sale of sensitive data to foreign entities. Prosecutors appealed the sentence in response to these actions.

In his opinion to overturn the initial sentence, U.S. Court of Appeals Judge Paul V. Niemeyer said that Fitzpatrick's actions showed "a lack of remorse," adding that the district court "never addressed the seriousness of his crimes or explained how its sentence fulfilled" the legal requirements. The appellate ruling sent the case back for resentencing.
